CONSENT STATEMENT

This Consent Statement will authorize and allow HTLand, Inc. (“HTLand”) and its affiliates subsidiaries, related parties, and agents to collect, use, process and disclose your Personal Information in our possession or under our control.

In this Consent Statement, the terms “we,” “us,” and “our” refer to HTLand and all its affiliates, subsidiaries, related parties, and agents, and third parties doing business with or under HTLand, its affiliates, subsidiaries, related parties and/or agents.

The term “you” and its derivatives refer to buyers, customers, visitors/guests, suppliers, partners, and employees and other stakeholders of HTLand.

A. Collection

Personal data that we collect refers to personal data, personal information, sensitive personal information (all as defined under the Data Privacy Act of 2012 [Republic Act No. 10173] and its Implementing Rules and Regulations) and other data or information about you from which you can be identified either (a) from that data alone; or (b) from that data combined with other information (herein colletively referred to as “Personal Information”) such as but not limited to:

    1. Information related to your identity, i.e., your name, gender, place and date of birth, nationality, civil status, permanent and present residential address, contact details, and details of government-issued registrations, facial images in a photograph or video recording, fingerprint and any other information relating to you which you have provided to us in any form you have submitted to us, or in other forms of interaction with you;
    2. Information relating to your financial capacity, such as but not limited to bank account details, credit history and/or credit card information;
    3. Information about your use and visit of our websites and services, including cookies, IP addresses, subscription account details and membership details; and
    4. Information relating to your educational and professional background, such as but not limited to curriculum vitae, employment and medical history.

  4. Your Personal Information may be collected by us, directly or indirectly, in the following instances:

    1. when you respond to our promotions, surveys and other marketing and sales initiatives, and subscribe to our mailing lists or mobile applications;
    2. when you use, purchase, or avail any of our products, services, activities, promos and events;
    3. when you visit our websites or showflats and/or register or submit information through online forms on our digital assets (i.e., websites, apps), or contact us through telephone, email, or any of our social media accounts (i.e., Facebook, Twitter, Instagram, LinkedIn, etc.);
    4. when you submit information in any forms to our employees or duly authorized representatives/agents;
    5. when you visit our premises with CCTV surveillance cameras or when your photographs or videos are captured during our events or while when you are within our premises;
    6. when you enter into transactions with us, or express any interest in doing so, including in relation to all properties we own, manage or operate;
    7. when we receive references from business partners and third parties;
    8. when you submit a job application to us;
    9. when we seek information about you and receive your Personal Information in connection with your relationship with us; and
    10. when you submit your Personal Information to us for any reason.

    When you disclose to us Personal Information of another person (e.g., your dependent, spouse, children, and/or parents), you attest that consent has been obtained from that person to disclose and process his/her Personal Information in accordance hereof.

  5. Purposes of Collection, Use or Disclosure

    Depending on your dealings with us, we may use or process, and/or disclose your Personal Information to serve the following purposes:

    1. To conduct and complete your transactions with us (e.g. processing orders and payments; providing products or services that have been requested), including the performance of our obligations or exercise of our rights as set out in our contract or sales documents, and otherwise to manage your relationship with us;
    2. to conduct direct marketing in relation to the products and/or services of HTLand and all its affiliates, subsidiaries, related parties, and its business partners and selected third party providers, including inviting customers or potential customers to events, coordinating property and/or showflat viewings and other marketing and promotional events;
    3. to manage your visit in properties owned, managed or operated by us;
    4. to process your participation in our in-mall promotions, redemptions, contests and other marketing and promotional events;
    5. security and safety purposes in connection with our premises or events organised by us, including conduct of background checks, security screening and issuance of access passes;
    6. To provide customer service (e.g. providing information on status and updates) and respond to your queries, requests and/or complaints;
    7. To facilitate and process your application for a membership account or subscription to our mailing list or mobile application;
    8. To process information for statistical, analytical, marketing, advertising, and market opinion research purposes.
    9. Prevention, detection, and investigation of crime, including fraud and money-laundering, and analysis and management of other commercial risks;
    10. Compliance with the requirements of the law and legal proceedings, such as court orders, and legal obligations; prevention of imminent harm to the public; and ensuring public security, safety, and order;
    11. to administer any part of a sales process including preparation of necessary sales documentation and any other documentation in relation to your transaction with us, delivery of notices or communications, verification of your identity, facilitating viewings, handing over possession, co-ordinating addition and alteration work and defect rectification;
    12. Performing financial processes related to your contract with us, such as the set-up of down payment, processing payments or credit transactions, amortization, financing, following up on outstanding arrears and other payment obligations and performing other actions necessary or desirable in the implementation of our contract;
    13. to manage our infrastructure and business operations and to comply with our internal policies and procedures;
    14. to facilitate any proposed or actual business assignment, transfer, participation or sub participation involving us;
    15. if you apply for employment or become our employee, to conduct appropriate background investigation, reference checks, pre-employment medical examination and to collect information about your suitability for the position applied for, organise training and staff development programs, assess your performance, administer benefits and payroll processing, provide you with tools to do your job and to communicate with you to comply with our policies and processes;
    16. to share your Personal Information with members of HTLand, and other parties set out herein for any of the purposes specified in this paragraph;
    17. such purposes that may be informed to you when your Personal Information is collected; and
    18. any other reasonable purposes and/or incidental business purposes related to or in connection with the aforementioned purposes.

    We may also collect, use, process, store and/or disclose Personal Information for other legitimate purposes related to our business and also in circumstances other than set out in this Consent Statement where required, or permitted, by laws applicable in our jurisdiction.

  6. Consent to Data Collection

By submitting your Personal Information pursuant to any of your dealings with us or by accessing this website, you consent to the collection, use, storage and all other forms of processing of your Personal Information in accordance with this Consent Statement. Any disclosure of Personal Information pertaining to another person (such as spouse, partners, dependents, or emergency contact persons) shall be construed as bearing the consent of such third party.

B. Disclosure and Sharing of Personal Data

We shall secure and keep your Personal Information confidential. However, it may be necessary for us to disclose and share your Personal Information to third party companies, entities, or service providers engaged by us to perform certain services on our behalf, including the following:
  1. our respective affiliates, subsidiaries, related parties, and associated companies, business partners and joint venture partners;
  2. Government agencies such as GSIS, SSS, PhilHealth, HDMF, courts, tribunals and regulatory authorities;
  3. Banking and financial institutions;
  4. Contractors or sub-contractors;
  5. External advisors and other professional advisors, such as auditors and lawyers;
  6. Insurance providers;
  7. Such other service providers that may be appointed by us including but shall not be limited to background investigators, debt collection agencies and providers of administrative, financial, research, operational, telecommunications, information technology, payment, training, market research and storage and archival services; and
  8. any actual or prospective investor, assignee or transferee to facilitate business asset transactions involving HTLand and its affiliates, subsidiaries, and related parties.

C. Security Measures

To safeguard your Personal Information from unauthorized access, collection, use, disclosure, copying, modification, disposal or similar risks, we have introduced appropriate administrative, physical and technical measures, including to protect Personal Information from unintended access. 

However, you should be aware that no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee that our systems or applications are invulnerable to security breaches. We make no warranty, guarantee, or representation that your use of our systems or applications is safe and protected from viruses, worms, Trojan horses, and other vulnerabilities. 

We keep your Personal Information only for so long as we need the Personal Information to fulfill the purposes we collected it for, and to satisfy our business and/or legal purposes, including audit, accounting or reporting requirements. In some circumstances, we may anonymize your Personal Information so that it can no longer be associated with you, in which case we are entitled to retain and use such information without restriction.

D. Cookies and Website Tracking

When you visit our websites, please note that we may use cookies and similar tracking mechanisms and devices, for purposes such as monitoring the number of times you visit the websites, which pages you go to, and how long you spend browsing each page. This information helps us build a profile of our users and improve our websites and other products and services. Where data is only used on an aggregated basis, we will be unable to identify any particular individual, and we generally track on per-device basis.
